Terms of Use — Prodshot

These Terms of Use ("Terms") govern your use of the Prodshot mobile app ("Prodshot," "the app," "we," "us"). By downloading or using Prodshot, you agree to these Terms. If you don't agree, please don't use the app.

What Prodshot does

Prodshot lets you upload product photos and uses AI (via OpenAI's image API) to generate styled, marketing-ready versions of those photos. Generated images are stored locally on your device. Some features require an active Pro subscription.

Acceptable use

You agree to use Prodshot only for lawful purposes. You will not:

Upload photos containing illegal content, or content depicting real people without their consent (e.g., non-consensual images of individuals).
Upload content that infringes someone else's intellectual property, trademark, or copyright.
Attempt to use Prodshot to generate sexually explicit, violent, hateful, or otherwise abusive imagery, or to bypass OpenAI's content moderation.
Reverse-engineer, decompile, or attempt to extract the app's source code, API keys, or backend logic.
Use automated tools, bots, or scripts to abuse the generation service or exceed your subscription's intended usage.
Resell or redistribute access to the app's generation service itself (as opposed to the images you create with it).

We reserve the right to suspend or terminate access for anyone who violates these terms or misuses the service.

Your responsibility for uploaded photos

You are solely responsible for having the rights to any photo you upload. By submitting a photo to Prodshot, you confirm that you own it, have permission to use it, or otherwise have the legal right to submit it for AI processing and to create derivative images from it. Prodshot is not responsible for verifying ownership or rights to content you provide.

AI-generated content disclaimer

Images produced by Prodshot are generated by AI and may not always be accurate, may contain visual artifacts or unexpected elements, and are not guaranteed to be fit for any particular commercial, legal, or marketing purpose. You should review generated images before using them publicly or commercially.

AI image generation is provided by OpenAI's API. Prodshot does not control, and is not responsible for, the underlying model's behavior, availability, or output quality. Service interruptions or changes on OpenAI's end may affect Prodshot's functionality.

You are responsible for how you use generated images, including ensuring they comply with advertising standards, platform policies (e.g., marketplaces, social media), and applicable law in your jurisdiction.

Subscriptions and billing

Prodshot offers an auto-renewing subscription ("Pro") that unlocks additional generations and features. Subscriptions are billed through your Apple ID via the App Store, and entitlement status is managed using RevenueCat.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to.
You can manage or cancel your subscription anytime in iOS Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep Pro access through the end of the period you already paid for.
Refunds are handled by Apple according to Apple's own refund policies — we are not able to issue refunds directly.

Free usage limits

Non-subscribed use of Prodshot is subject to a monthly generation cap, tracked locally on your device. This cap resets monthly and may change at our discretion.

Intellectual property

The Prodshot app, its design, branding, and underlying code are owned by us and protected by applicable intellectual property laws. Subject to your compliance with these Terms, you retain ownership of the photos you upload and the images Prodshot generates for you, for your own use.

Limitation of liability

Prodshot is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to lost profits, lost data, business interruption, or reliance on AI-generated content, even if we've been advised of the possibility of such damages.

Our total liability for any claim arising from your use of Prodshot will not exceed the amount you paid us in the 3 months preceding the claim.

Termination

You may stop using Prodshot at any time by deleting the app. We may suspend or terminate your access to the app if you violate these Terms. Because Prodshot doesn't use accounts, "termination" primarily means restricting access to the generation service tied to your device/subscription.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "last updated" date above. Continuing to use Prodshot after changes are posted means you accept the revised Terms.

Governing law

These Terms are governed by the laws applicable in the jurisdiction in which Prodshot is operated, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.
